The WA Worker’ Comp scheme is based on a ‘no-fault’ principle. This means you do not have to establish that your employer was at fault or negligent to make a workers’ compensation claim.

Construction, building or industrial work sites often have a complex mix of workers from a number of trades engaged by a number of different companies including labour hire. Regardless of whether anyone was to blame for your workplace injury, you will likely have a valid claim for workers’ compensation under the WA Workers’ Comp no fault scheme.

Owners, occupiers, lessors, lessees, tenants, property managers and strata companies must provide a safe premises for visitors, attendees and guests. Injuries caused by slips, falls or falling objects, where negligence can be proved, will be compensable by law.

There are many other circumstances, not just those involving a premises, where public liability will apply.

The Dog Act 1976 (WA) imposes strict liability on dog owners and people in control of dogs for injuries caused by a dog attack. Compensation can be claimed not only for injury caused by biting and mauling but also for injury caused by other types of aggressive behavior such rushing, jumping or lunging. If the victim falls to the ground as a result of an attack, then compensation can also be claimed for any injury suffered in the fall. The victim of a dog attack will be able to claim even if no one was at fault or negligent.

The Fatal Accidents Act 1959 (WA) allows the family members or dependents of a deceased person to seek compensation if the death was caused by a wrongful or negligent act or omission.

If a loved one has died due to injuries caused by the negligence of another person or company, then relatives may have claim to compensation for economic loss due to the loss of financial dependency as well as loss of services that the deceased would have provided.

The Criminal Injuries Compensation Act 2003 (WA) sets out the legal framework for compensating victims of offences and crime.  For victims who have suffered physical or psychological injuries the scheme is designed to provide compensation for injuries (pain and suffering), loss of income, expenses related to medical and psychological treatment and loss of some limited types of personal items (such a damaged clothing).

For a close relative of a victim who dies as a result of a criminal offence, the scheme is designed to provide compensation for loss of financial dependency, loss of domestic or parental service and funeral expenses.

You may have TPD insurance that has been arranged by your Superannuation fund managers, or you may have TPD insurance that you have arranged privately with or without the help of a financial adviser.

Different policies will have different definitions of TPD. Most policies with have more than one definition of TPD. Most will state that for an injury or medical condition to be covered under TPD, it must be severe enough such that the insurer is satisfied that it is unlikely that you will ever again be able to work in your occupation or in any other occupation for which you are suited by reason of your education, training or experience.
TPD benefits are payable as a single lump sum, are in addition to and paid without having any effect on your superannuation retirement fund.

Understanding the Process

The process of making a compensation claim

Step 1.

Report the accident

As soon as reasonably possible, report the accident to the relevant person, company or authority.

Depending on the location and circumstances of the accident, the relevant person or authority could be an employer, the police, a property manager, a security officer, a local council or a government department.

Step 2.

See a doctor

See a doctor as soon as reasonably possible after the accident to ensure that the necessary medical investigation and treatment. Report all symptoms both physical and psychological.

Some claims, such as workers’ compensation claims, will require a specific type of medical certificate. If time off work is required, make sure that you get required medical certificate.

Step 3.

Give notice of the accident and submit a claim to insurer

Different claims types will have different notification and submission requirements. Motor vehicle and workers’ compensation claims have specific accident report forms and claim forms.

Other types of claims will also have time limits that need to be complied with for giving notice of the accident or for submitting a claim form.

Step 4.

See a lawyer

It is highly recommended to seek advice from a personal injury specialist to understand & decide whether legally representation is required. This is important whether or not your claim has been accepted by the insurer.

A personal injury specialist be able to advise on whether you have a valid claim, entitlements to compensation, what steps to take to preserve your claim, steps to maximise the claim, timeframes and more.

Step 5.

See you doctor regularly

Continue to see your doctor regularly, and ensure you continue to receive the appropriate treatment to make the best possible recovery.

It is also important for proper presentation of the claim that that there is good medical record or “paper trail”. Claims can take over a year to be concluded. Some claims can take a few years. Doctor’s notes recording symptoms and other issue along the way are more reliable than your memory of things that happened a year or two in the past.

Step 6.

Regular provision of documents to the insurer

In some claims such as workers’ compensation and motor vehicle claims, there is a requirement that medical and other documentation are submitted to the insurer regularly for payment of ongoing compensation entitlements such as medical expenses and income compensation.

With some other claims there is an expectation that the insurer or its lawyer will be regularly updated and provided with documents such as medical reports.

Step 7.

Preparation of the claim for settlement negotiation

As a claim nears settlement negotiations, all aspects of the claim and compensation entitlements will have been thoroughly investigated. Evidence such as medical reports, accident reports, and financial records will have been gathered and exchanged with the insurer or its lawyer. In many cases written settlement submissions will be prepared and given to the insurer or its lawyer.

Before a claim progresses to settlement negotiation you will be given all the advice you need to make fully informed and proper decisions during the settlement negotiation.

Step 8.

Settlement of your claim

In some claims such as workers’ compensation and motor vehicle claims, there is a requirement that medical and other documentation are submitted to the insurer regularly for payment of ongoing compensation entitlements such as medical expenses and income compensation.

With some other claims there is an expectation that the insurer or its lawyer will be regularly updated and provided with documents such as medical reports.

Step 9. Formal Settlement

If settlement is reached, then the settlement needs to be formalised in writing. Sometimes that is done by a written agreement, sometime by filing a court document and sometimes both. In most cases other documents are required to be submitted to Government departments notifying of the settlement.

It is important that all settlement documents are properly prepared is that all terms of the settlement reached are payable and enforceable.
