How does No Win No Fee work?
Legal fees vs legal disbursements
The legal costs of a running a personal injury claim are legal fees and legal disbursements.
Legal fees are the amounts paid to lawyers for their time, effort and expertise. For most types of claims fees will be charged in accordance with scales of costs. The scales are published every couple of years and are determine by a legal cost committee. The scales allow for fees to be calculated and charged basically (but not quite) on an hourly rate method.
Legal disbursements are monies paid to third parties for things that are needed to progress your case – things like court fees, medical records, GP and specialist reports and medicolegal examinations and reports.
You will be fully aware of all of these costs by way of a detailed written estimate before your case is commenced, and you will receive further advice of costs along the way.
What does "win" in no win no fee mean?
A win means the successful outcome of your claim by the receipt of lump sum compensation or benefits either by settlement of the claim or by way of a final judgement, decision or award in your favour (as may be relevant to your case).
Put simply a win is if you receive lump sum compensation or a payout for your claim.
No up-front payments
If we as assess your case as having reasonable prospects of success, then we will assist you with payment of disbursements and in most cases no deposits, up-front payments or down-payments will be expected. In fact, in most cases that we run, any costs incurred for disbursements (such a medical report or court fees) will be paid for by Klein Compensation Law along the way.
Do you have to pay anything up front or along the way?
The answer in almost all cases we take on is No. You will only pay once your case has finished, and you have received your lump sum compensation.
What legal costs are paid by the insurer if I win and what do I pay?
In almost all of our cases that win, in addition to your compensation payout, the Insurance Company will also pay a good portion of your legal fees, and it will pay reasonably incurred legal disbursements. Those amounts will be covered directly by the Insurance Company and any shortfall will be deducted from your compensation payout.

When will get a bill for legal fees if I win
